Betreibung explained: Switzerland's debt enforcement system (English guide)

The short answer: a Betreibung is a formal debt-collection procedure any creditor can start against you for allegedly unpaid bills – it lands in the debt enforcement register (Betreibungsregister) that landlords and employers routinely check. How it works

Creditor files → you receive a payment summons (Zahlungsbefehl) → you have 10 days to object (Rechtsvorschlag – one signature, no reason needed) → objection forces the creditor to prove the claim in court. Never ignore the summons: unanswered, it proceeds toward seizure.

The register problem

Entries stay visible for years even for disputed or paid claims – and Swiss landlords request the extract (Betreibungsregisterauszug) with almost every application. Paid entries can be marked; unfounded ones can be removed via a formal request or court – worth pursuing before flat-hunting.

The stages, and where each one can be stopped

It begins with the creditor's request to the debt enforcement office, which issues a payment order (Zahlungsbefehl). Receiving one does not mean the claim is proven – anyone can initiate proceedings for any alleged amount, which is exactly why the next step matters so much.

Within ten days you may file an objection (Rechtsvorschlag), free of charge and without justification, at the office or on the document itself. This halts proceedings and forces the creditor to establish the claim through legal channels. Missing this ten-day window is the most consequential deadline in the entire process.

If no objection is filed and the debt is not paid, the creditor can request continuation, leading to seizure (Pfändung) of income above the subsistence minimum or of assets. Costs accumulate at every stage and are added to the original claim.

Third, document everything: the date of receipt, the objection, any agreement reached. In disputes about whether an objection was filed in time, documentation decides – and the burden falls on the person who did not keep it.
